This section sets forth the Terms and Conditions of Sale for DUXIANA.com. DUXIANA.com (website) is part of DUXIANA, a national network of company operated and independently operated DUXIANA stores that sell and deliver DUXIANA products. By completing a purchase with us online, you agree to the following Terms and Conditions and to be bound by them. Please note that terms and conditions may differ in independently owned DUXIANA stores.
CANCELLATION AND CHANGES:
You may cancel your order at no cost prior to shipment from our facility. Once your order is in transit, cancellation may incur a return shipping fee up to $450. Likewise, refused deliveries will incur a return shipping fee.
We cannot accept order cancellations on any custom-made items past 72 hours after order placement.
Beds are non-returnable once delivered except as spelled out in warranty.
Furniture (including Jetson Chairs), top pads, headboards, legs, upholstered bed skirts, linens, pillows, duvets, and mattress protectors are non-returnable once delivered, except in the case of defects.
Due to the personal nature of our products, all sales are final. No returns or refunds can be accepted.
DELIVERY AND INSTALLATION:
You will be contacted by a DUXIANA representative within 2 business days to coordinate delivery of DUX Beds and Furniture. Smaller items such as linens and pillows may ship separately via parcel carrier.
Seller is not liable for delay or failure to deliver or perform due to strikes, differences with workmen, war, riot, fire, pandemic, inability to comply with government regulations, acts of God, failure of sources of supply or delay in receipt thereof, or any other causes beyond its control. Seller is not responsible or liable for any acts or omission on the part of its subcontractors, including but not limited to, delivery and installation personnel.
DUX bed legs may be installed on the bed upon delivery. If the delivery service is instructed by customer to place the bed in or on customer’s own frame/platform, etc., Seller is not liable or responsible if damage should occur to the DUX bed or frame/platform, headboard, etc.
“White Glove Delivery” includes bringing products into home (including up to two flights of stairs), unpackaging, installing DUX legs and headboard (if applicable), and removal of all debris. Not included are removal of existing mattresses and/or furniture, rearranging other articles within home, and installation of soft goods such as sheets and pillows. Please prepare for your delivery by removing existing mattresses or furniture from the area DUX/DUXIANA products are to be installed.
“Threshold Delivery” includes bringing products into home and placing them in a safe location up to 10 feet from the front door of the unit or house. For apartment/condo deliveries: items will be delivered as above to your unit or apartment number. In cases where building elevators are not available or not large enough, travel of up to two flights of building stairs are included. No unpacking or debris removal is included with “Threshold Delivery” method.
It is the responsibility of Buyer to make sure their DUX purchases will fit into their building, unit, bedroom, and/or bedframe/platform. This includes any access points such as doorways, stairways, hallways, elevators and around corners into the desired location. Please contact customer service for instructions on measuring your home's spaces to ensure items will fit at the time of delivery.
Deliveries which are rejected due to no-fit scenarios will incur a return shipping fee of up to $450.
At time of delivery, Purchaser should examine items carefully and note visible damage or shortage on the delivery receipt and notify carrier’s claims department immediately. All packing materials must be retained until inspection is made. If Purchaser accepts and/or signs for goods that are damaged or lost in transit, he does so at his own risk and expense.
Seller warrants that the items sold will be free from defects resulting from faults in construction, materials or workmanship when used properly and in accordance with the instructions and directions provided. Buyer's remedies under this paragraph will be enforceable against Seller only if (a) Seller is notified of the claim hereunder within two weeks after receipt or discovery thereof by the Buyer and (b) not more than one year shall have elapsed between the passage of title to Buyer and the date of the notice to Seller described in (a). No waiver, alteration or modification of this paragraph shall be valid unless made in writing and signed by an executive officer of Seller.
This warranty is non-transferable. The original purchaser of each DUX mattress sold to Buyer hereunder is entitled to the benefits of a limited warranty against breakage of or defects in the spring system occasioned by normal wear and tear, however, the liability of Seller to Buyer under this warranty shall be limited to replacement or repairs, at its option, and this shall be the Buyer's sole remedy. In no event will Seller be liable for consequential or indirect damage, including but not limited to, loss of profit, loss of goodwill, costs of capital or costs incurred in connection with substitute sources of supply.
